Abstract
Avrupa Birligi ve Amerika Birlesik Devletleri arasındaki ticari iliskiler, taraflardan\nbiri tarafından olusturulan ticari engeller sebebiyle, sürekli anlasmazlıkların yasandıgı\nbir iliski olarak süregelmistir. Güncel ve önemli bir anlasmazlık da tarımsal\nbiyoteknoloji ve gıdalardaki genetigi degistirilmis organizmalar konusu üzerinedir.\nABD, Avrupa Birligi’nin, genetigi degistirilmis organizmaların onaylanması ve ithalatı\nkonusunda moratoryum uygulayarak, ticareti gereksiz yere engelledigini iddia\netmektedir. 1998 yılından 2004 yılına kadar Avrupa Birligi tarafından sürdürülen\nmoratoryum, Amerika’nın ekonomik kayıplar vermesine ve Avrupa Birligi’ne gıda\nihracatında azalmalara sebep vermistir. Dolayısıyla, Amerika; Kanada ve Arjantin’le\nbirlikte, konuyu 2003 Mayıs ayında Dünya Ticaret Örgütü’nün Anlasmazlık\nÇözümleme Organı’na tasımıstır.\nBu çalısmanın asıl amacı, Avrupa Birligi ve Amerika arasında genetigi\ndegistirilmis organizmaların ticareti konusundaki anlasmazlıklarının altında yatan\nsebeplerini bulup, çözümler sunabilmektir. Bu amaçla, tarafların uyguladıgı farklı\ndüzenleyici çerçeveler, aynı teknolojiye farklı bakıs açılarını yansıtması açısından, bir\naraç olarak sunulmustur. Ayrıca, dünyada genetigi degistirilmis gıdaların\ndüzenlenmesine yönelik genel egilimler ve anlasmazlıkla ilgili hükümler içeren\nuluslararası anlasmalar ele alınmıstır.\nÇalısmanın sonucunda, her iki tarafın da genetigi degistirilmis gıdaların\ndüzenlenmesine yaklasımı, eksik bulunmustur. Dolayısıyla her iki yaklasımın da,\ngenetigi degistirilmis organizmaların uluslararası ticaretinin kolaylastırılması için\ndüzeltilmesine ihtiyaç vardır. Çalısmanın diger bir sonucu da, Dünya Ticaret\nÖrgütü’nün, yerel risk-yönetimi düzenlemelerinin uygunlugunu yargılama konusunda\nyeterli ve genis-tabanlı bir kurum olmadıgı ve genetigi degistirilmis organizmaların\nDünya Ticaret Örgütü’nden daha kapsamlı, farklı bir kurum tarafından ele alınması\ngerekliligidir.\n ABSTRACT\nThe commercial relations between the European Union (EU) and the United\nStates (US) have been characterized by constant disputes concerning the creation of\ntrade barriers by one of the parties. One recent and important controversy concerns\nthe agricultural biotechnology and the Genetically Modified Organisms (GMOs) that\nare included in food products. The US claims that the EU is unnecessarily creating\nbarriers to trade by applying a moratorium on the approval and import of GMOs. The\nmoratorium, which was in place from 1998 to 2004, has already caused some\neconomic losses to the US and decline in exports of food products to the EU.\nTherefore the US, together with Canada and Argentina, took the issue to the World\nTrade Organization (WTO) Dispute Settlement Body , on May, 2003.\nThe main aim of this study is trying to find the reasons of and some solutions to\nthe transatlantic trade dispute on GMOs. Therefore, a description of the different\nregulatory frameworks for GMOs is included as a tool for understanding the different\ninstitutional perspectives to the same technology. Also the general regulatory\npatterns of GMOs in the world and the international agreements that may have a\nbearing on the dispute are handled.\nThis study concludes that both parties’ regulatory approach to GMOs are\nflawed. Therefore, both approaches must be amended to facilitate international trade\nof GMOs. Another conclusion is that the WTO is not a broad-based institution to\nadjudicate on the appropriateness of domestic risk-management regulations and\nGM crops requires an international regulatory approach that is broader in remit than\nthe WTO.
