Abstract
Les demandes d'autorisation de soins constituent une exception au respect du droit constitutionnel à l'inviolabilité de la personne humaine et sont étroitement encadrées, en droit québécois, par des paramètres stricts et bien définis. C'est aussi un enjeu complexe dont l'issue dépend intimement des circonstances particulières à chaque patient au bénéfice de qui l'autorisation est demandée. À la lumière de l'obligation constitutionnelle de pondérer les droits et intérêts en conflit, comment les tribunaux québécois conjuguent-ils en pratique le droit à l'autodétermination des patients majeurs à risque d'être jugés inaptes à consentir? À cet égard, la jurisprudence québécoise des dernières années semble balisée par un critère pragmatique, quoiqu'implicite, de la capacité des personnes à pallier leurs symptômes perturbateurs dans le respect des droits d'autrui.
