Abstract
Nell’esaminare il sindacato di costituzionalità, il lavoro muove dal tentativo di superare le classificazioni tradizionali, ancorate alla fase del controllo, alla diffusione o concentrazione del medesimo, all'efficacia delle decisioni delle corti (o tribunali) costituzionali, fondando la disamina sulla dicotomia tra controllo astratto e controllo concreto.\nNell'analizzare la reference jurisdiction, oltre che nella madre patria inglese, negli Stati Uniti, Canada e Irlanda, la monografia intende dimostrare che anche in sistemi palesemente influenzati dal modello americano di giustizia costituzionale le antiche influenze britanniche non mancano di farsi sentire, dando luogo a forme inedite di controllo astratto. \nNello specifico caso dell'attività consultiva delle Corti, il rilievo che essa assume è testimoniato — oltre che da una ampia serie di casi ripercorsi nella loro evoluzione storica, dalla diversa concezione degli istituti affrontati in sede processuale. \nLe ragioni di analogie e differenze vengono individuate in svariati elementi, di natura storica, filosofica (il diverso modo di concepire la divisione dei poteri), politica, oltre che tecnico-processuale (la diversa concezione del ruolo delle corti e delle procedure adottate in sede di judicial review).
