Abstract
Op 1 juli 2021 bereikten 130 van de 139 landen van het OECD/G20 Inclusive Framework on Base Erosion and Profit Shifting (IF) overeenstemming over een herziening van het internationale winstbelastingsysteem. Op basis van twee pijlers wordt beoogd te komen tot een wereldwijde oplossing voor de uitdagingen die de digitaliserende economie meebrengt voor de belastingheffing van multinationals. Pijler 1 betreft aanpassing van de regels over belastbare aanwezigheid en winsttoerekening, waardoor landen waar een multinational klanten heeft in voorkomende gevallen meer winstbelasting kunnen heffen, ook indien deze multinationale onderneming in dat land niet fysiek aanwezig is. Pijler 2 moet waarborgen dat grote multinationals altijd minstens een minimumniveau aan winstbelasting betalen. De OESO publiceerde op 1 juli 2021 een Statement met daarin de kerncomponenten van beide pijlers. Ook publiceerde de OESO een overzicht van de aangesloten landen. Een meer gedetailleerd document met een implementatieplan en resterende knelpunten komt eind oktober 2021. Onder de 130 committerende landen bevinden zich de G7-landen (Canada, Duitsland, Frankrijk, Italië, Japan, Verenigd Koninkrijk, Verenigde Staten), die begin juni al overeenstemming bereikten over hoe een wereldwijde oplossing er volgens hen moet uitzien, Brazilië, Rusland, India en China, alsmede landen als Luxemburg, Nederland, Singapore, Zwitserland en Bermuda en de Kaaimaneilanden. IF-landen Barbados, Estland, Hongarije, Ierland, Kenia, Nigeria, Peru, Sri Lanka, Saint Vincent en de Grenadines hebben zich niet bij het akkoord van 1 juli 2021 aangesloten. Dit geldt ook voor Cyprus, dat geen IF-land is. Op 9 en 10 juli 2021 komt in Venetië de G20 samen om de overeenkomst te formaliseren. In het Statement is een ambitieus implementatietijdpad opgenomen. De pijlers moeten van kracht worden in 2023. De staatssecretaris van Financiën stuurde de Tweede Kamer op 5 juli 2021 een brief over het akkoord in het Inclusive Framework over de herziening van het internationale belastingsysteem (nr. 2021-0000131418).
