Abstract
Este trabajo analiza la secesión de territorios en la Constitución española. En\nprimer lugar, hay que constatar que el texto constitucional afirma la «indisoluble unidad»\nde España, lo que excluye la posibilidad de secesión de territorios sin previa reforma de\nla Constitución. La exigencia de reforma, sin embargo, no viene motivada por la singular\nrefacción del artículo 2 de la Constitución, sino que es consustancial a los sistemas democráticos,\naunque no incluyan, de forma expresa, la indisolubilidad del Estado. Pero, el análisis\nconstitucional de la secesión, ¿debe concluir con esta constatación? En los últimos decenios\nse ha ido construyendo un nuevo paradigma constitucional sobre la forma en que las\nConstituciones democráticas deben abordar las reclamaciones secesionistas, atendiendo a los\nprincipios que subyacen a la Constitución. Esta vía es la que han desbrozado países como\nCanadá, al afrontar la reclamación de independencia de Québec, o Reino Unido, al afrontar\nla reclamación de independencia de Escocia. Este trabajo trata de analizar la forma en que\nestos principios son aplicables en la Constitución española.This paper analyzes the seccesion of territories under the Spanish Constitution.\nFirst, we must note that the Constitution provides the «indisoluble unity» of Spain; that\nmeans that the secession of territories without prior amendment of the Constitution has to be\nexcluded. But the need for constituional Amendment, however, in general rule which applys\nto all democratic Constitutions, even them which doesn’t include expressly the State’s indissolubility.\nBut does that means thatconstitutional analysis of secession should conclude with\nthis statement? In the last decades it has been building a new constitutional paradigm about\nhow democratic constitutional systems muss adress secesionist claims, according to the principles\nunderlying the Constitution. Countries like Canada, regarding claims for sovereignty\nof Québec, and United Kingdom, regarding claims for Independence of Scotland, have gone\ndown this path. This paper attemps to analyze how these principles apply in the Spanish\nconstitutional system.
