Le point de départ de cette étude est le constat du niveau de complexité avancée qui caractérise l’administration publique contemporaine. Dans une perspective matérielle, les actions administratives comprennent un contenu de plus en plus délicat. Dans une perspective institutionnelle, l’administration publique avance en direction de la pluralité de centres décisionnels. La combinaison des deux aspects est particulièrement importante. Afin de traiter de thèmes progressivement complexes, le législateur se met à dessiner attentivement des autorités administratives spécialisées. Le surcroît de la complexité matérielle et institutionnelle de la nouvelle administration publique génère la curiosité scientifique à propos de l’ampleur de la complexité parallèle du droit administratif, afin de s’ajuster ou d’être mis en adéquation avec cette réalité nouvelle. D’où la question : sous quelle forme et dans quelle mesure le droit administratif est-il adapté à la nouvelle administration publique ? Cette étude se préoccupe spécifiquement de l’impact que la complexité matérielle et institutionnelle de l’administration publique contemporaine exerce sur la détermination de l’intensité du contrôle juridictionnel du contenu de ses décisions. Elle examine l’adaptation de l’intensité du contrôle juridictionnel aux caractéristiques des actions administratives contrôlées et des entités qui les accomplissent. L’examen est fait à la lumière de quatre systèmes juridiques : Canada, États-Unis, France et Italie. Résultat d’une recherche doctorale menée auprès de l’Université Paris 1 (Panthéon-Sorbonne) et de l’Università di Roma (Sapienza), l’étude a obtenu le Prix Levy-Ullmann de la Chancellerie des Universités de Paris en 2015.
