[Resumen]La tesis se divide en tres capítulos. En el primero se desarrolla una clasificación de las formas de Estado, distinguiendo entre unitario y federal (la Confederación no es un Estado) y unos elementos determinantes que deben existir para considerar que un Estado tiene naturaleza federal. Con esta metodología, en el segundo capítulo, se hace un estudio comparado de estos elementos en nueve países (Estados Unidos, Canadá, México Argentina, Alemania, Suiza, Austria, España e Italia) y en la Confederación europea. En este capítulo se desarrolla la primera gran conclusión del estudio: que tanto en Europa como en América se producen efectos de imitación de los ordenamientos que se consideran “modélicos” que no siempre producen los efectos deseados. En el tercer capítulo, desarrollamos la que es la segunda gran conclusión de nuestro estudio: que en Europa el proceso de integración europea y la descentralización en los Estados miembros se retroalimentan, recibiendo influencias recíprocas. Para alcanzar esta conclusión centramos el estudio en la protección de los derechos y en la distribución de competencias en los estados Europeos. [Resumo]A tese divídese en tres capítulos. No primeiro desenvólvese unha clasificación das formas de Estado, distinguindo entre unitario e federal (a Confederación non é un Estado) e uns elementos determinantes que deben existir para considerar que un Estado ten natureza federal. Con esta metodoloxía, no segundo capítulo, faise un estudo comparado destes elementos en nove países (Estados Unidos, Canadá, México, Arxentina, Alemaña, Suíza, Austria, España, Italia) e na Confederación europea. Neste capítulo desenvólvese a primeira gran conclusión do estudo: que tanto na en Europa como en América prodúcense efectos de imitación dos ordenamentos que se consideran “modélicos” que non sempre producen os efectos desexados. No terceiro capítulo desenvolvemos a que é a segunda gran conclusión do noso estudo: que en Europa o proceso de integración europea e a descentralización nos Estados membros retroaliméntanse, recibindo influenzas recíprocas. Para alcanzar esta conclusión centramos o estudo na protección dos dereitos e a distribución de competencias nos Estados europeos. [Abstract]The thesis is divided into three chapters. In the first chapter a classification of the State forms, distinguishing between unitary and federal (Confederation is not a State) and some determining elements that must be exist in order to considerate a State have federal nature is developed. With this methodology, in the second chapter, a comparative study of these elements in nine countries (United States, Canada, Mexico, Argentina, Germany, Switzerland, Austria, Spain and Italy) and the European Confederation is made. In this chapter the first major conclusion of the study is developed: both in America and Europe imitation effects respects countries that are considered “exemplary” that not always produce desire effects occur. In the third chapter, we develop which is the second major conclusion of our study: in Europe, European integration and decentralization in the Member States are fed back, receiving reciprocal influences. In reaching this conclusion, the study focused on the protection of rights and the distribution of powers in the European states.
