Aujourd’hui, les Peuples Autochtones revendiquent le droit de vivre en harmonie avec leurs ontologies, qui impliquent la transmission intergénérationnelle d'un savoir ancestral, évoluant selon une conception circulaire du temps. Cependant, cette transmission de savoir a été largement empêchée pendant longtemps par l'entreprise coloniale, et les Peuples Autochtones s’attèlent maintenant à reconstruire progressivement leurs ontologies, ce qui contracte les demandes autochtones entre le passé, le présent et le futur. Différemment, dans la théorie du droit occidentale contemporaine, le temps juridique, et plus largement, la légitimité du droit, reposent sur une vision linéaire du temps, où le passé, le présent et le futur sont séparés dans une quête vers le progrès. Prenant appui sur une analyse du cas Ktunaxa (Cours Suprême du Canada, 2017), cet article vise à démontrer que cette différence de temporalité peut empêcher les cours et tribunaux occidentaux de rendre justice aux demandes autochtones. Il explore ensuite les possibilités de mieux inclure la temporalité autochtone dans le droit via la triple distinction mémoire inerte/mémoire vive, souvenir/héritage et vérité construction/vérité dévoilement. A cet égard, il argue que traiter équitablement les demandes autochtones requiert l’inclusion de nouveaux concepts, soit la mémoire vivifiée, l’héritage futur et la vérité judiciaire dévoilée.
