Ця стаття присвячена огляду становлення законодавства про звільнення від відбування покарання в Канаді (паролє), основних стадій розвитку звільнення від відбування покарання, ролі державних інституцій в цьому процесі, основних ознак старої і сучасної системи звільнення від відбування покарання в Канаді. Надано порівняльну оцінку сфер можливого вдосконалення процесуального законодавства України щодо звільнення від відбування покарання з метою приведення його до кращої практики та принципів гуманізації кримінальної політики.
\nThe paper reviewed the evolution of legislation on the release from (serving) punishment (Parole)
\nin Canada, emphasizing the separate story of Canada Parole in the Common Law Family Countries.
\nThe key stages of the parole development, role of government institutions, essential features
\nof the old and modern system of Parole in Canada described and systemized for further study. The
\nkey features of the Canadian Parole Laws identified. Preliminary comparative assessment of the
\nareas of possible improvements of the Ukrainian release of punishment legal procedures to meet
\nthe best practice and humanitarian principals provided. The paper takes the approach from based on
\nkey aspects of Parole development in Canada: public safety; transparency and openness; fair rules.
\nThe certain core features of each aspects identified. The paper reads the consequent stages of the
\nParole development with a tendency to rehabilitation and correction focus rather than punitive. In a
\nsummary paper puts in place the preliminary recommendations on the streams of the further study
\ntowards development of the advanced models of the Parole in Ukraine. The possible options for the
\nParole legislation improving are listed. The Parole Board of Canada staffing also discussed and the
\nmerit base approach suggested. The primary focus is on the Parole decision-making procedures and
\nrespective rules, which should ensure the protection the offenders’, victim’s and public safety interest,
\nmaintaining the certain balance responding to public expectations and needs.
\nЭта статья посвящена анализу становления законодательства об освобождении от отбывания наказания в Канаде (пароле), основных стадий развития освобождения от отбывания наказаний, роли государственных институций в этом процессе, основных признаков изначальной и современной системы освобождения от отбывания наказания в Канаде. Дана предварительная сравнительная характеристика сфер возможного усовершенствования процессуального законодательства Украины по вопросу освобождения от отбывания наказания з целью приведения его в соответствие с лучшей практикой и принцами гуманизации уголовной политики.
