Abstract
Las arenas bituminosas son un tipo de yacimiento no convencional de hidrocarburos que podría tener un gran potencial en Colombia. Sin embargo, a partir de lo ocurrido con el fracking y debido a la incertidumbre en materia científica, legal, económica y ambiental que pueden presentar este tipo de proyectos, se evidencian muchas vulnerabilidades al momento de intentar desarrollarlos. Por lo anterior, este trabajo busca establecer cuál es marco ambiental colombiano en la actualidad en dado caso que se decidiera desarrollar un proyecto de exploración o explotación de arenas bituminosas; teniendo en cuenta quiénes serían los entes gubernamentales competentes que podrían estar al tanto de este tipo de proyectos, instrumentos que existen en la actualidad como los términos de referencia para poder realizar los respectivos estudios ambientales y si estos son suficientes. Adicional, se hará una comparación con la normatividad ambiental de la provincia de Alberta, Canadá y la normatividad colombiana, para poder establecer qué similitudes o diferencias existen y a partir de ellas poder concluir qué hace falta en la normatividad ambiental colombiana en dado caso de presentarse la posibilidad de desarrollar exploración o explotación de arenas bituminosas como yacimiento no convencional de hidrocarburos, reduciendo así la incertidumbre frente a este tipo de proyectos.
