Questo contributo esplora il concetto di prassi istituente proposto da Pierre Dardot e Christian Laval e lo approfondisce, rileggendo le pagine sartriane che erano state d’ispirazione per i due autori. L’intento è quello di sostare sul momento istituente, tentando d’isolare una materia prasseologica che abbracci anche le tecniche giuridiche e sia, per questo verso, capace di superare un certo dogmatismo che considera il diritto sempre esclusiva- mente come mera sovrastruttura. L’andamento di questo con- tributo è il seguente: inizialmente si isolerà il concetto di “prassi istituente” attraverso gli autori che hanno offerto un appiglio teoretico al concetto; di qui, si sonderà la relazione fra prassi e materia – che è al centro delle speculazioni neomaterialiste con- temporanee – attraverso il pensiero sartriano, e in particolare si sosterà sul concetto di “controfinalità”, per poi aprire l’indagine sull’istituire e sul sociale, e, in special modo, sulla “praxis senza autore” che, da Sartre, ci traghetterà verso le riflessioni deleuzia- ne sugli istinti e le istituzioni, e le operazioni del diritto di Yan Thomas. Più largamente questa ricerca si inserisce negli studi di Law and Society, che aspira a innovare mediante una visione meno meccanica della relazione fra sociale e giuridico.
