Los trastornos parafílicos en agresores sexuales y su tratamiento jurídico-penal : aproximación teórica y análisis jurisprudencial en España

Abstract
Las parafilias son cada vez más frecuentes en las distintas sociedades, de hecho, siempre han existido (de Dios, 2007). Sin embargo, cuando estas suponen la única fuente de placer sexual del individuo, devienen patológicas y, por ende, se convierten en Trastornos Mentales de la esfera de la sexualidad conocidos como Trastornos Parafílicos (Colombino, 1999; López y Labrador, 2020). Esta investigación explora parte de la literatura científica existente sobre los Trastornos Parafílicos, haciendo especial hincapié en su influencia en los agresores sexuales y en la calificación que reciben a nivel jurídico-penal; aportando también la valoración de profesionales de la psicología, la psiquiatría, la medicina forense y el derecho al respecto. La metodología desarrollada se basa en el análisis jurisprudencial de una muestra de 30 sentencias sobre delitos de agresión sexual, cometidos en España y por sujetos afectados por Trastornos Parafílicos distintos de la pedofilia. Los resultados evidencian que, generalmente, estos no se califican como delitos y que, por sí solos, no suponen Circunstancias Modificativas de la Responsabilidad Criminal, hecho que incentiva la realización de nuevas propuestas y abre diversas líneas de investigación, tales como la posibilidad de modificaciones en el Código Penal y nuevas maneras de calificar los Trastornos Parafílicos.
