Abstract
Suite à la jurisprudence Viking et Laval de la Cour de Justice de l’Union Européenne, les libertés économiques ont pris le pas sur le droit de grève. Ce mémoire est l’occasion de revenir sur l’évolution du point de vue de l’Union sur les droits sociaux et sur la consécration du droit de grève dans les différents textes internationaux. Ceci afin de mieux comprendre pourquoi la Cour a adopté un tel raisonnement. Ensuite, nous poursuivons avec une analyse des arrêts Viking et Laval, ainsi que de la réponse donnée par la Cour européenne des Droits de l’Homme dans l’arrêt Enerji, sur base de l’article 11 CEDH. Enfin, nous terminons avec toutes les hypothèses redorant le blason du droit de grève en lui donnant la place et la protection de droit fondamental qu’il mérite face aux libertés économiques. Pour ce faire, nous envisageons les possibilités de revirement de jurisprudence de la CJUE, un changement du droit secondaire et enfin, la révision des Traités fondateurs.
