Abstract
Con il contratto di trasporto un soggetto, denominato vettore, si obbliga dietro corrispettivo a trasferire cose o persone da un luogo ad un altro, ed al tempo stesso a vigilare sulla loro incolumità. Sebbene i contratti di trasporto della navigazione si inquadrino nella figura di trasporto di diritto generale, il codice della navigazione distingue tra trasporto marittimo e trasporto aereo. Per quanto riguarda il trasporto aereo, il codice della navigazione rimanda alla Convenzione di Montreal del 1999 in tema di responsabilità per morte o lesioni al passeggero, avaria o distruzione del bagaglio e ritardo, non comprendendo però le ipotesi della cancellazione del volo e l’overbooking, in quanto disciplinate a livello comunitario. In ambito marittimo, la responsabilità vettoriale è regolata dal codice della navigazione, unitamente alla Convenzione di Atene del 1974, emendata dal Protocollo di Londra del 2002. Infine, accanto al contratto di passaggio, partire dagli anni 70, il legislatore internazionale ha iniziato a disciplinare il nuovo fenomeno dei pacchetti turistici all- inclusive e la conseguente tipizzazione del contratto di viaggio.
