Les amateurs culinaires du monde entier considèrent la gastronomie comme une chance pour les papilles ainsi qu'une richesse pour les patrimoines culturels et économiques nationaux. Un premier réflexe serait donc d'encadrer cet objet concentrateur de valeurs. Pourtant, l'appréhension de la cuisine par le droit demeure par de nombreux aspects limitée. S'il existe un droit de l'alimentation riche et fourni, lorsqu'on se penche sur la protection des créations culinaires, c'est-à-dire des plats et recettes innovants, créatifs ou séculaires, on reste sur notre faim. L'étude détaillée du droit de la propriété intellectuelle, droit des créations par excellence, révèle en effet que les régimes qui le composent peinent à se saisir de ces biens particuliers. Le présent mémoire s'attache à décrire les difficultés rencontrées pour la protection des créations culinaires en droit de la propriété intellectuelle français et canadien. Le droit d'auteur ne considère pas ces objets comme des œuvres de l'esprit, et les titres de propriété industrielle ne pallient que de manière imparfaite à ce rejet. L'analyse se porte donc ensuite sur les perspectives d'évolution qui permettraient de leur accorder une meilleure reconnaissance. À cette occasion, il sera démontré qu'un revirement jurisprudentiel dans le domaine de la propriété littéraire et artistique se présenterait comme une solution pertinente en réponse aux attentes des métiers de bouche, plutôt que l'adoption d'un système sui generis dispensable
