La tesi propone un'analisi della questione indipendentista scozzese, a partire dalla storia della nazione e dall'evoluzione del suo sistema costituzionale, dalle origini fino agli sviluppi più recenti. L'elaborato si focalizza sul sistema costituzionale britannico, con particolare riferimento all'esperienza devolutiva in atto in Scozia e delle peculiarità che caratterizzano tale esperienza, rispetto alle altre nazioni che compongono il Regno Unito. È inoltre affrontato il tema delle recenti esperienze referendarie scozzesi, con un approfondimento relativo al dibattito sviluppatosi attorno al referendum indipendentista svoltosi nel 2014, sulle fasi del suo complicato svolgimento e le conseguenti implicazioni giuridiche nel sistema plurinazionale del Regno Unito. La pronuncia della Corte Suprema del Regno Unito, interpellata per risolvere una delle questioni più controverse circa la volontà di indire un secondo referendum, costituisce la vicenda a cui è dedicata maggiore attenzione. Segue un'analisi del fenomeno indipendentista scozzese in relazione alla scelta del Regno Unito di recedere dall'Unione europea e del rapporto che intercorre tra il diritto di secessione e il processo di integrazione europea. La questione scozzese è analizzata infine in una prospettiva comparata. Analizzando il caso della Catalogna in Spagna e del Quebec in Canada, si forniscono le coordinate necessarie per comprendere le ragioni che hanno dato vita a fenomeni simili all'esperienza avvenuta in Scozia e si dà conto di come queste esperienze si caratterizzino per essere dalla volontà di autoaffermazione nel quadro geopolitico internazionale.
