De l'interprétation des textes législatifs plurilingues : Comparaison d'études portant sur la jurisprudence en Suisse, au Canada et dans l'Union européenne

Abstract
Dans les systèmes juridiques plurilingues, les textes législatifs sont disponibles en plusieurs versions linguistiques. Le présent mémoire s'intéresse aux méthodes d'interprétation appliquées par les juridictions de dernière instance pour résoudre les divergences qui peuvent survenir entre ces versions. Il porte sur trois systèmes juridiques différents, soit la Suisse, le Canada et l'Union européenne. En nous basant sur les études de la jurisprudence déjà réalisées dans chacun de ces systèmes, nous comparons l'état de la recherche et les méthodes appliquées par les juges dans ces systèmes. Nous analysons également la place accordée à la traduction dans les études et dans la jurisprudence. Enfin, nous discutons de l'influence du contexte politique, juridique et linguistique sur le choix des méthodes d'interprétation et l'intérêt porté à cette thématique
