Abstract
L'elaborato intende fornire un'analisi quanto più dettagliata del fenomeno dell'elusione fiscale, quale strumento preordinato dal contribuente ad alterare la reale manifestazione di capacità contributiva, al fine di sottrarsi in tutto o in parte al proprio dovere d' imposta. Per anni il legislatore tributario ha cercato di porre un freno alle pratiche elusive attraverso la produzione di fattispecie normative ad hoc, ma la vera svolta si registra a partire dal 2006, quando la Corte di Giustizia Europea interviene in materia di IVA, con la nota sentenza Halifax, richiamando il principio del divieto di abuso del diritto. E' proprio sulla scorta di questa pronuncia che la Corte di Cassazione abbraccia un nuovo indirizzo e ritiene applicabile il principio antiabuso di matrice comunitaria quale strumento di contrasto all'elusione fiscale, anche con riguardo ai tributi non armonizzati. Sul fronte normativo, attesa la necessità che l'istituto dell'abuso del diritto trovi posto nel nostro ordinamento, sono state presentate alcune proposte di legge volte a codificare l'istituto in questione nel sistema tributario. A tal proposito verrà dato conto, in modo approfondito, della recentissima legge delega n. 23 dell'11 marzo 2014, con la quale il legislatore disposto l'emanazione di un provvedimento che disciplina dell'abuso del diritto in campo tributario.
