Abstract
Els esforos per a l'harmonitzaci del dret civil dins de la Uni Europea, fins i tot amb l'expectativa d'un codi civil europeu (cf.les resolucions del Parlament Europeu de 26 de maig de 1989 (DOCE C-158, de 26 de juny de 1989, p. 400) i de 6 de maig de 1994 (DOCE C-205, de 25 de juliol de 1994, p. 518) i ara la Comunicaci de la Comissi al Consell i al Parlament Europeu sobre dret contractual europeu d'11 de juliol de 2001 (DOCE C-255, de 13 de setembre de 2001, p. 1)), han contribut a despertar l'inters pels anomenats sistemes legals mixtos, anomenats aix per la interacci que en aquests despleguen el civil law i el common law.En efecte, sovint s'ha destacat que el principal obstacle a una veritable convergncia juridicocivil a Europa rau en la profunda divisi existent entre el common law i els ordenaments jurdics continentals.Els sistemes mixtos, en la mesura que hi coexisteixen elements procedents d'ambdues tradicions, constituirien un excellent laboratori on poder comprovar les possibilitats d'xit d'un dret civil unificat a Europa, i encara ms si es t en compte que algun d'aquests ordenaments, com el de Louisiana o el del Quebec, estan codificats.Per aix no pot estranyar que en els darrers cinc anys hagi proliferat en el nostre continent la publicaci de llibres que els estudien, entre els quals mereixen ser destacats els segents: Robin Evans-Jones (ed.)
