all’evoluzione dell’istituto stesso. In secondo luogo, viene esaminato in tutte le sue sfaccettature l’accoglimento dell’optio legis nel Titolo III Capo VII all’art. 46 della legge n° 218 del 1995 intitolata “Riforma del sistema italiano di diritto internazionale privato”; precisamente vengono trattati i principali punti critici emersi dall’esegesi dell’articolo, quali: la dichiarazione espressa in forma testamentaria, il principio del carattere unitario della successione e l’esclusione del cd. depeçage, il limite del criterio del doppio collegamento e della inderogabilità dei diritti successori dei legittimari residenti in Italia al momento della morte del de cuius ed in ultimo la scelta della legge applicabile nella divisione ereditaria. Il secondo capitolo s’incentra invece sull’analisi del regolamento UE n° 650 del 2012 che si sostituisce alle normative nazionali degli Stati membri in materia. Il regolamento regola tutti gli aspetti internazionalprivatistici di una successione: la competenza, la legge applicabile, la circolazione delle decisioni giudiziarie e degli atti pubblici; in particolare e specularmente al capitolo primo, a seguito di una breve disquisizione sulla genesi e sull’ambito di applicazione del Regolamento, vengono rilevate e trattate singolarmente tutte le criticità che emergono dalla lettura dell’art. 22 dello stesso, il quale riconosce al suo interno la facoltà in capo al de cuius di designare la legge applicabile alla propria successione. Infine, al capitolo terzo, viene analizzato l’istituto dell’electio iuris in materia successoria nel diritto internazionale privato del Canada quale ordinamento plurilegislativo. In particolare, vengono prese in considerazione le sei maggiori province del Canada, Ontario, British Columbia, Alberta, Manitoba, Sasckatchewan e Québec, conferendo maggiore importanza all’analisi della normativa di quest’ultima provincia, la quale riconosce l’istituto all’art. 3098 del Code Civil du Québec, a differenza delle restanti cinque che non permettono tale libertà.
