Ter erkenning van hun leed heeft de wetgever nabestaanden een recht op affectieschadevergoeding gegeven. Niet elke nabestaande heeft echter een onverkort recht hierop. Naast een vaste kring van gerechtigden, kunnen ook ‘overige nauwe persoonlijke relaties’ van het overleden slachtoffer affectieschadevergoeding vorderen. Met behulp van een systematische jurisprudentieanalyse is de realisatie van dit recht, en de rechterlijke invulling van de hardheidsclausule onderzocht. Broers en zussen vormen de grootste groep nabestaanden die voor hun schadevergoeding afhankelijk zijn van de rechterlijke invulling van deze open norm. Open normen hebben consequenties voor de rechtszekerheid en kunnen resulteren in een te grote rechterlijke vrijheid. De rechtspositie van broers en zussen staat momenteel ter discussie waarbij verschillende juridische kernwaarden een rol spelen. In dit artikel wordt een rechtstheoretische reflectie geboden op de mate waarin de rechterlijke besluitvorming voor broers en zussen tegemoetkomt aan de waarden rechtvaardigheid, doelmatigheid en rechtszekerheid.
