Abstract
A travers la décision par laquelle le Conseil d’Etat a refusé de reconnaître le caractère représentatif de l’U.N.S.A. au niveau national et interprofessionnel, cette étude analyse les critères de la représentativité, tels que les a légués l’histoire du syndicalisme, et surtout tels que les interprètent les juridictions internationales, les arbitres, la Chambre sociale de la Cour de Cassation et le Conseil d’Etat. Cette décision a pour spécificité de limiter la pertinence de l’examen de la satisfaction des critères législatifs de la représentativité syndicale au secteur privé, ainsi qu’au secteur public soumis à des conventions collectives. L’implantation de la requérante étant principalement forte dans le secteur public, le juge administratif ne la considère pas, pour l’instant, représentative au niveau national. Il semble ainsi préserver l’avenir et laisser au pouvoir politique l’initiative d’une modification du paysage syndical français. Plusieurs considérations suggèrent néanmoins qu’en pérennisant, au terme d’une argumentation dont certains éléments n’emportent pas la conviction, la situation privilégiée de la C.G.T., de F.O., de la C.F.D.T., de la C.F.T.C. et de la C.F.E.-C.G.C., le Conseil d’Etat a pu contribuer à hypothéquer la dynamique du syndicalisme contemporain.
