La culture de la détention provisoire est une problématique urgente, tant en France qu'au Canada. Effectivement, une utilisation massive et pas toujours raisonnée de la détention provisoire peut être relevée dans les deux pays. Si les données sont un peu moins alarmantes en France, il est quand même nécessaire d'enrayer une telle culture dans les deux pays étudiés, l'usage de la détention provisoire étant discriminatoire, concernant des délits de faible gravité et risquant de porter atteinte à des droits fondamentaux du prévenu. Néanmoins, si les acteurs judiciaires sont conscients depuis plusieurs années des dangers que représente l'usage impressionnant de la détention provisoire, ils ne semblent pas pour autant être prêts à abandonner la culture d'une telle mesure. Il ressort même que le droit pénal est inapte à rompre la culture de la détention provisoire. Notamment, le cadre juridique ne parvient pas à encadrer l'usage de la détention provisoire de façon suffisamment restrictive, les conditions permettant de recourir à ladite mesure étant trop larges et les alternatives à ladite mesure ne convainquant pas. Également, la pérennité de la culture de la détention provisoire semble inévitable en ce qu'elle est appuyée par les pratiques judiciaires adoptées par les juges, et par les objectifs contradictoires poursuivis par le législateur.
