Abstract
De demotie van (oudere) werknemers en het daarmee samenhangende wijzigingsvraagstuk waarin een evenwicht moet worden gevonden tussen het streven naar meer interne functieflexibiliteit in hoofde van de werkgever enerzijds en de bescherming waarop de werknemer daarbij kan rekenen anderzijds, leggen enkele knelpunten van het Belgische arbeidsrecht bloot.\n\nWetgeving, rechtspraak en rechtsleer verschaffen helaas onvoldoende duidelijkheid om tot een evenwichtige oplossing te komen. In deze masterscriptie tracht ik de lezer langs vrijwel alle knelpunten inzake de aanpasbaarheid van de bedongen functie in het kader van demotie wegens disfunctioneren te loodsen door een grondige analyse van zowel het arbeids- als het gemeen verbintenissenrecht te maken.\n\nDeze scriptie onderzoekt onder meer:\n' het wijzigingsrecht van de werkgever;\n' de goede trouw als arbeidsrechtelijk principe; en\n' de actiemiddelen tegen ongeoorloofde wijzigingen.\n\nTot slot worden enkele voorstellen de lege ferenda geformuleerd, dewelke aanbevelingen zijn ter inspiratie van de Belgische wetgever.
