La proposta del diritto transnazionale è una nuova ipotesi metodologica per definire ulteriormente le frontiere del diritto comparato. L’esigenza di ripensare e ridefinire categorie concettuali e nuovi approcci metodologici, al fine di misurare nuove forme di pluralismo giuridico, appare necessaria per confrontarsi con le continue trasformazioni dello spazio giuridico, nonché dei cambiamenti sociali. Se la globalizzazione risulta ostativa rispetto alla democrazia, il diritto transnazionale, invece, si caratterizza per modalità tipicamente democratiche. Non è solo un’ulteriore distinzione fra le due concezioni, ma piuttosto una evoluzione della transnazionalità in luogo della globalizzazione con ricadute in punto di diritto costituzionale. La connotazione del diritto transnazionale nel prisma della legittimazione democratica avviene attraverso un’analisi della partecipazione dei cittadini e degli “interessati” alle decisioni, che si intendono assumere nel contesto di un processo decisionale transnazionale. Non si tratta solo di referendum o forme più o meno autentiche di democrazia diretta, specie quelle attuate per il tramite di Internet. Lo sguardo, piuttosto, è rivolto a quanto di recente si è manifestato nei trattati internazionali di libero scambio c.d. di nuova generazione , come per esempio quello, per ora congelato, fra UE e USA del TTIP e quello, operativo, fra UE e Canada del Ceta. \nIl libro è stato presentato (prof. P. Passaglia) e discusso nell'ambito del primo incontro di studio organizzato dal Dottorato in Scienze Giuridiche e dai membri del progetto di ricerca dell'Ateneo pisano 2018-2019 su "Diritto senza politica. Le forme della produzione giuridica nell'epoca transnazionale", presso il Dipartimento di Giurisprudenza dell'Università di Pisa, 19-12-2018. Le riflessioni del Seminario sono poi state pubblicate nella rivista Lo Stato, n. 14/2020 (autori: S. Marinai, P. Calonico, L. Ricciardi, A. Gatti, S. Sassi, R. Tarchi). \nIl libro è stato anche lo spunto per il Convegno "Pluralismo costituzionale e regolamentazione degli spazi transnazionali", tenuto presso la Facoltà di Scienze Politiche Economiche e Sociali, Università Statale di Milano, 5-6-2019. Raffiotta). \n \n \n \nThe proposal of transnational law is a new methodological hypothesis to further define the frontiers of comparative law. The need to rethink and redefine conceptual categories and methodological approaches, in order to measure new forms of legal pluralism, is necessary to confront the continuous transformations of the legal space, as well as social changes. If globalization is hostile to democracy, transnational law, on the other hand, is characterized by typically democratic methods. It is not just a further distinction between the two concepts. It is rather a development of transnationality instead of globalization with repercussions on constitutional law. The connotation of transnational law within the framework of democratic legitimacy takes place through an analysis of the participation of citizens and 'interested parties' in the public decisions which they intend to take in the context of a transnational decision-making process. It is not just a question of referendums or more or less authentic forms of direct democracy, especially those implemented via the Internet. Rather, it looks at what has recently manifested itself in the so-called new generation of international free trade treaties, such as the TTIP, for now frozen, between the EU and the USA, and the Ceta, operational, between the EU and Canada.
