En el presente Informe Jurídico procederé a analizar un proceso civil sobre
\nOtorgamiento de Escritura Pública. La demanda de Otorgamiento de Escritura
\nPública fue interpuesta por don CEMC y doña JSOD en contra de don VNAA y doña
\nVMC. En el presente proceso, la sentencia de primera instancia, de fecha 26 de
\nsetiembre del 2016, se declaró fundada la demanda respecto al Otorgamiento de
\nEscritura Pública. Luego, una de las partes demandada, don VNAA, apeló la
\nsentencia en mención, solicitando que se eleve al superior jerárquico con el fin de
\nque la demanda se declare infundada; esta, se concede posteriormente con efectos
\nsuspensivos el 03 de febrero del 2017. Paralelamente, la parte codemandada, doña
\nVMC, declarada rebelde inicialmente, presenta su apersonamiento y nombramiento
\nde abogado el 09 de marzo del 2017, para luego –con fecha 13 de marzo del 2017-
\n, interponer recurso de apelación y solicitar la nulidad de todos los actos procesales
\nhasta la etapa de admisión de la demanda. A ello, el 19° juzgado civil responde que,
\nhabiéndose concedido ya la apelación con efectos suspensivos, solicitado por don
\nVNAA, la presente judicatura perdió la competencia, razón por la cual su pedido
\ndeberá ser solicitado en la instancia superior. Presentando aquella su pretensión en
\nla sala superior, la Quinta Sala Civil declara, mediante resolución, improcedente la
\nnulidad formulada por doña VMC. Finalmente, la Corte Superior de Justicia de Lima
\nrevoca la sentencia de primera instancia de Otorgamiento de Escritura Pública,
\nreformándola y declarándola improcedente.
