Cet ouvrage a vocation à éclairer le lecteur sur l'utilisation de l'institution séculière de l'arbitrage afin d'appliquer la charia dans l'agencement de ses relations affectives et familiales, ainsi que sur les effets civils en Belgique des sentences arbitrales prononcées par les tribunaux arbitraux musulmans, qu'elles soient exequaturables ou non. A cette fin, il est d'abord procédé à une analyse des modes alternatifs de résolution des conflits et à leur importance en droit. En deuxième lieu, est examinée la notion de charia: sa définition, son contenu, et sa compatibilité avec les valeurs démocratiques occidentales. Troisièmement, il est procédé à une étude de la situation de trois pays où se sont instituées des instances arbitrales musulmanes réglant des conflits en matière familiale: le Canada (Québec et Ontario), le Royaume-Uni et les Etats-Unis. Pour chacun de ces pays il est procédé à une analyse du droit relatif à l'arbitrage et à la jurisprudence concernant la reconnaissance et l'exécution des sentences arbitrales et contrats à caractère religieux. Enfin, la dernière partie examine comment il peut être aujourd'hui fait référence à la charia, si l'arbitrage constitue un moyen efficace pour régler ses relations affectives et familiales conformément à la charia, et s'il existe d'autres pistes d'application de la charia en Belgique.
