El presente trabajo de investigación tiene por objeto el estudio de la obligación
\nprecontractual de información aplicable al proveedor de créditos hipotecarios en el derecho
\nchileno en el marco del Proyecto Fondecyt “La obligación precontractual de los proveedores
\nde productos o servicios financieros de informar al consumidor en el derecho chileno.
\nInsuficiencia de la normativa que la regula. Bases y criterios para perfeccionarla”
\n(Nº11180826). Para ello, se exponen las principales características de la obligación
\nprecontractual de informar aplicable al proveedor de créditos hipotecarios, tales como su
\nnaturaleza, clasificación, extensión y fundamentos. A continuación, se analiza de forma critica
\nel estado actual de la legislación nacional en la materia, abordando en primer término el ámbito
\nde aplicación objetivo y subjetivo de la obligación precontractual de informar al consumidor que
\npesa sobre el proveedor de créditos hipotecarios y los requisitos generales aplicables a la
\ninformación que debe transmitirse, para posteriormente revisar de forma pormenorizada el
\ncontenido de la obligación de dicha obligación a la luz de la legislación vigente. Por último, se
\nexaminan de forma detallada las consecuencias de la infracción de la obligación precontractual
\ndel proveedor de créditos hipotecarios de informar al consumidor, con especial énfasis en las
\nconsecuencias de derecho privado
