Papas pudieron adaptar su sistema legal a las necesidades concretas de las personas y de las sociedades (en la medida en que los matrimonios de los reyes eran asunto político de primer orden).En la concesión de la dispensa, que debe ser siempre legítima, sí entran las motivaciones (es más deben entrar).Aquí se abre todo un campo para juzgar el uso de este mecanismo por los Papas, pero no debe olvidarse que la posibilidad de dispensar (lo que se puede dispensar) es un requisito esencial para que el derecho cumpla su función de garantizar lo que en justicia corresponde en cada caso.Al servicio de la concepción cristiana del matrimonio, de su efectiva protección, surge el derecho procesal canónico.Aquí de nuevo nos encontramos con la agradable sorpresa de un Autor que ve más allá de las formalidades técnicas del proceso, su finalidad de proteger los bie-nes en juego (desde el derecho de defensa al bien mismo del matrimonio).Concluyo, pues, estas líneas deseando que hayan constituido una invitación a la lectura.Deliberadamente se ha omitido un resumen de sus contenidos, sólo útil para libros que no resulta necesario leer.Éste sí.Como los anteriores del autor en esta temática.Quien quisiera una síntesis de sus conclusiones, que lea el último capítulo (Ten theses and an argument); allí D'Avray sintetiza las páginas anteriores casi de modo matemático.Allí está lo que ha demostrado con sus estudios.«Demostraciones» (entiéndase esta palabra en el sentido propio de la investigación histórica) que le hacen merecedor de la más calurosa felicitación y del más sincero agradecimiento.
