Rahapelaaminen on ihmislajin varhaisimpia ajanvietteitä. Sitä on pyritty eri tavoin sääntelemään jo antiikin ajoista lähtien, eikä rahapelaaminen ole koskaan ollut vain ala muiden joukossa. 
\n
\nTässä tutkimuksessa analysoidaan Suomen ja Ruotsin kansallisten rahapelijärjestelmien ja niitä koskevan sääntelyn kehitystä rinta rinnan EU-oikeuden kanssa. Tutkimus vastaa kysymyksiin siitä, miten EU-oikeudessa on eri aikakausina suhtauduttu rahapelaamiseen, miten Suomen ja Ruotsin kansallisen rahapelisääntely on kehittynyt erityisesti 1900- ja 2000-luvuilla ja mitä yhteiskunnallisia, oikeudellisia ja teknologisia syitä näiden muutosten taustalle on paikallistettavissa. Lisäksi analysoidaan, miksi sääntely on kehittynyt niin kuin se on kehittynyt. Tutkimusote on paitsi lainopillinen, myös korostetun oikeushistoriallinen ja oikeusvertaileva.

\nTutkimuksen keskeisiä havaintoja ovat Suomen, Ruotsin ja Euroopan unionin rahapelejä koskevan sääntelyn jakautuminen kolmeen ajanjaksoon: monopolien kulta-aikaan, online-rahapelejä koskevien linjausten ja Ruotsin järjestelmän murtumisen aikaan sekä oikeuskäytännön teknisten täsmennysten ja kansallisten lainsäädäntömuutosten aikaan.

\nEU-rahapelioikeuden muodostuminen tapahtui suurelta osin jo 1990-luvun lopulla ja 2000-luvun alussa. Tänä aikana EU-tuomioistuin loi tulkintansa peruspilarit, joita se on sittemmin toistanut myöhemmissä tapauksissa. EU-oikeuden paine kohdistui järjestelmiin kuitenkin toden teolla vasta 2000-luvulla, jolloin EU-komissio aloitti monipuoliset toimet alalla. Tässä paineessa Suomi pystyi korjaamaan järjestelmäänsä niin, että Euroopan komissio katsoi sen olevan sopusoinnussa sisämarkkinalain-säädännön kanssa. Ruotsi sen sijaan joutui useiden rikkomusmenettelyiden kohteeksi ja sen kansallinen rahapelisääntely asettui unioninoikeuden valossa kyseenalaiseksi, johtaen monopolijärjestelmän hallitsemattomaan purkautumiseen.

\nLainsäädännössä Suomen ja Ruotsin järjestelmien eriytyminen tapahtui vuonna 2019, mutta käytännössä jo huomattavasti aiemmin.
