Le commerce électronique a été intégré pour la première fois comme sujet dans un accord de libreéchange en 20011 . Depuis, le nombre d’accords de libre-échange qui intègrent le commerce électronique a augmenté régulièrement et atteint désormais 30 % de tous les accords de libre-échange notifiés à l’OMC. Le commerce électronique fait partie de pratiquement tous les accords commerciaux mégarégionaux récents, notamment l’Accord de partenariat transpacifique global et progressiste, l’Accord entre le Canada, les États-Unis et le Mexique, et le Partenariat économique global régional. Le 10 février 2020, la Conférence des chefs d’État et de gouvernement de l’Union africaine : « [A DÉCIDÉ] que les négociations de la phase III se concentrent sur un protocole de la ZLECA sur le commerce électronique immédiatement après la conclusion des négociations de la phase II » et « [A CHARGÉ] la Commission de l’Union africaine d’amorcer les préparatifs des négociations à venir et de mobiliser des ressources en 2020 pour le renforcement des capacités des négociateurs commerciaux africains participant à la négociation des instruments juridiques du commerce électronique au niveau de la Zone de libre-échange continentale africaine ». La présente note d’information propose une illustration des types des questions pouvant être traités dans le protocole de la Zone de libre-échange continentale africaine (ZLECA) sur le commerce électronique. Elle plaide pour l’accélération des négociations notamment en raison de la pandémie de COVID-19, de l’impératif de mieux reconstruire pour la quatrième révolution industrielle, de l’intérêt de consolider une position panafricaine sur les questions de négociation du commerce électronique et de mieux permettre la cohérence avec les autres protocoles de la ZLECA.
