Abstract
L’encadrement juridique du harcèlement psychologique dans les milieux de travail québécois se caractérise par un morcellement normatif particulièrement prononcé. De façon générale, les lois du travail en la matière ont un objectif double : d’une part, la prévention du harcèlement, en imposant à l’employeur une obligation de rendre le milieu de travail exempt de harcèlement, et d’autre part, la réparation des dommages subis par la personne victime. Ces lois confinent généralement l’acteur syndical dans un rôle de représentation de la personne salariée victime de harcèlement, au stade de la réparation. Or, les recours individuels ne sont que rarement utiles à l’atteinte de l’objectif de prévention. Compte tenu du rôle limité que peuvent avoir les recours en matière de réparation, à quoi peut correspondre une implication accrue de l’acteur syndical dans la prévention du harcèlement et des risques qui en découlent? Le présent mémoire de maîtrise, dont les résultats se fondent sur une étude de terrain, s’intéresse aux interactions entre la prévention et la réparation du harcèlement, ainsi qu’à l’impact du morcellement normatif et institutionnel sur la pleine participation de l’acteur syndical à la prévention du harcèlement au travail. _____________________________________________________________________________ MOTS-CLÉS DE L’AUTEUR : morcellement, droit du travail, harcèlement psychologique, santé et sécurité, prévention, syndicat
