Abstrak \n \n \nBerdasarkan Pasal 3 Undang-Undang Republik Indonesia Nomor 23 tahun 2002 \ntentang Perlindungan Anak bahwa perlindungan anak bertujuan untuk menjamin \nterpenuhinya hak-hak anak agar dapat hidup, tumbuh, berkembang dan \nberpartisipasi secara optimal sesuai dengan harkat dan martabat kemanusiaan, \nserta mendapat perlindungan dari kekerasan dan diskriminasi, demi terwujudnya \nanak Indonesia yang berkualitas, berakhlak mulia dan sejahtera. Berkaitan dengan \nketerangan anak sebagai saksi dalam peradilan pidana bahwa kesaksian anak tidak \ndapat dipertanggungjawabkan secara sempurna dalam hukum pidana dan \nketerangannya hanya dipakai sebagai petunjuk saja. Sedangkan pengaruh anak \nsebagai saksi ialah untuk menambah keyakinan hakim jika ditunjang oleh alat \nbukti lainnya.Permasalahan dalam penelitian ini adalah bagaimanakah kekuatan \npembuktian keterangan anak sebagai saksi dalam peradilan pidana pada Studi \nPutusan No. 503/Pid.B(A)/2011/PNTK dan apakah yang menjadi dasar putusan \nhakim dalam menjatuhkan putusan terhadap pelaku. \nMetode yang digunakan dalam penelitian ini adalah melalui pendekatan yuridis \nempiris dengan menggunakan data primer dan data sekunder. Data sekunder \ndiperoleh melalui studi pustaka, kemudian data primer diperoleh melalui studi \nlapangan dengan cara observasi dan wawancara yang kemudian analisa data \ndilakukan dengan cara analisis kualitatif.
