Dans cette étude, nous allons aborder la question de la mise en œuvre du Protocole de Kyoto (PK) en Europe. Notre but est d'offrir une vision générale du système européen, en tant que modèle de développement normatif du Protocole, dans un contexte où il y a différents niveaux de gouvernement impliqués et qui a déjà avancé dans le but de garantir le respect des obligations qui découlent du PK. Il faut cependant prendre en compte la nature spécifique de la CE en tant qu'organisation internationale d'intégration. Tout parallélisme avec l'Espagne, qui est membre de la Communauté, ou avec le Canada, trouve ses limites dans le fait que la CE n'est pas un État. Premièrement, nous partirons de l'implantation du principe de responsabilités communes mais différenciées (PRCD) quant au Protocole, particulièrement de son incidence sur le partage des pourcentages de réduction des émissions, d'un côté, entre les États de l'annexe B du PK et, d'un autre côté, entre les États membres et la CE elle-même. Deuxièmement, nous ferons une brève analyse de la nature et de la portée de la compétence communautaire ainsi que des principaux instruments qui ont été adoptés afin de permettre la mise en œuvre du PK dès son entrée en vigueur, en portant une attention spéciale à la directive sur le système européen du commerce des émissions. Finalement, nous traiterons plus en détail la question de la participation des citoyens à l'application du PK dans le système de la CE et dans le cas particulier de l'Espagne.
