Abstract
Dalam Perjanjian Kredit antara kreditor (Bank) dan debitor, pihak kreditor \nakan meminta jaminan berupa Hak Tanggungan yaitu tanah atau tanah dan \nbangunan yang akan di buat dalam perjanjian accesoir agar kreditor dapat \nmenempati posisi sebagai kredtior preference. Bilamana debitor wanprestasi atas \nperjanjian kredit tersebut maka kreditor dapat melakukan parate eksekusi atas \nobjek jaminan Hak tanggungan tersebut dengan melalui pelelangan. \nSetelah lelang dilaksanakan, sering sekali terjadi pemenang lelang \nmengalami kesulitan dalam upaya untuk menguasai objek tersebut karena debitor \ntereksekusi menolak untuk mengosongkan dan meninggalkan objek yang masih \ndia dikuasai dan ditempati secara fisik. Bilamana hal ini terjadi pemenang lelang \ndapat melakukan upaya-upaya hukum sebagai upaya untuk menguasai objek \nlelang yang telah dimilikinya.
