Abstract
Con el transcurso de los años, la aplicación de la Ley 26639 quedó restringida en cuanto a los Embargos, por la Ley 28473 publicada en el Diario Oficial El Peruano el 18 de Marzo del 2005, al modificar el texto íntegro del artículo 625 del Código Procesal Civil, estableciendo que en los procesos iniciados con el Código de Procedimientos Civiles de 1912, la medida cautelar se extinguía de pleno derecho a los cinco años contados desde su ejecución; es decir quedaban excluida la posibilidad en adelante de caducar los embargos trabados en procedimientos seguidos con el Código Procesal Civil. A igual suerte fueron sometidos los embargos coactivos anotados bajo los alcances del Código Tributario, ya que por disposición del D. Leg. 953 publicado en el Diario Oficial El Peruano el 5 de Febrero del 2004, se estableció que las medidas cautelares trabadas bajo los alcances del Código Tributario no estaban sujetas a plazo de caducidad, ello en clara alusión a la Ley 26639.
