L’Accord sur les ADPIC a été adopté dans le but d’internationaliser la protection des droits intellectuels. Il prévoit plusieurs flexibilités en faveur des pays en voie de développement en matière de médicaments, flexibilités qui se révèlent rapidement comme étant inefficaces. La Déclaration de Doha de 2001, la Décision de 2003 mettant en oeuvre le paragraphe 6 de la Déclaration et la consécration de cette dernière Décision par l’insertion d’un nouvel article 31bis dans l’Accord traduisent la volonté de l’OMC de faciliter l’accès aux médicaments pour les pays en développement. Le Canada et le Rwanda sont les seuls à avoir appliqué le nouveau système de l’article 31bis, prévoyant des licences pour importation, ce qui traduit la complexité du système et son manque d’efficacité. L’épuisement international ainsi que la législation indienne en matière de brevet semblent constituer des pistes de solution pour faciliter l’accès aux médicaments. D’autres pistes de solution alternatives sont également proposées.
