Le 6 juin 2017, le projet de loi n° 98, soit la Loi modifiant diverses lois concernant principalement l'admission aux professions et la gouvernance du système professionnel, est sanctionné par l’Assemblée nationale du Québec. Malgré ce titre renvoyant à des notions d’admission et de gouvernance, cette loi poursuit également l’objectif que s’est fixé le législateur québécois en 1994 avec l’adoption de l’article 59.1 du Code des professions, soit la mise en place d’un système dit de « tolérance zéro » en matière d’inconduite sexuelle de la part des professionnels québécois. En effet, on y annonce qu’en cette matière, la loi « revoi[t] les sanctions disciplinaires applicables en matière d’acte dérogatoire à caractère sexuel, notamment en imposant une radiation d’au moins cinq ans au professionnel ». Plus de cinq ans après l’adoption de la Loi 11, nous sommes d’avis qu’il est plus que justifié de s’interroger à savoir si cette réforme des sanctions a porté ses fruits ou encore si elle est sur la voie de les porter. L’intention du législateur a-t-elle été respectée? Les instances disciplinaires ont-elles pris acte des mouvements sociaux tels que #MoiAussi qui ont secoué la société québécoise au même moment? C’est notamment à ces questions que tente de répondre le présent essai en comparant les cinq dernières années du régime antérieure avec les cinq premières années d’application de celui instauré par la Loi 11.
