Abstract
Il saggio analizza un’importante disposizione finale della Convenzione di Montreal del 1999, sull’unificazione di alcune norme per il trasporto aereo internazionale: l’art. 55, che disciplina il rapporto esistente tra il testo uniforme del 1999 e gli strumenti internazionali che compongono il cosiddetto sistema di Varsavia, vale a dire la Convenzione per l’unificazione di alcune regole relative al trasporto aereo internazionale del 1929, come modificata nel corso del tempo dai numerosissimi Protocolli di emendamento. La norma oggetto di indagine, che prima facie sembra porre il principio di prevalenza assoluta del più recente testo uniforme su quelli del Warsaw system, viene analizzata alla luce della varie fasi in cui si sono articolati i lavori preparatori della Convenzione del 1999 ed il diritto dei trattati. Attraverso questa rilettura, nello studio si giunge a ridelineare la reale dimensione precettiva della disposizione, e a ridimensionare le ricostruzioni interpretative di essa elaborate dalla dottrina, in specialmodo di common law.
