Abstract
Lo scritto analizza una recente ed importante ordinanza delle Sezioni Unite della Corte di Cassazione su uno dei criteri di collegamento contenuti nell'art. 33 della Convenzione di Montreal del 1999, sul trasporto aereo internazionale. Nella decisione i giudici hanno fornito un'interpretazione particolarmente evolutiva del criterio rappresentato dal luogo ove il vettore «possède un établissement par le soin duquel le contrat a été conclu»/«has a place of business through which the contract has been made» nel caso di acquisto on-line del titolo di viaggio. Tale luogo, infatti, secondo il collegio deve essere identificato, in applicazione del principio di prossimità, con il «luogo in cui l’acquirente del titolo di viaggio» è «portato a conoscenza dell’accettazione della proposta formulata con l’invio telematico dell’ordine e verosimilmente» del pagamento del corrispettivo, fatto coincidere con il domicilio dell’acquirente.
