Esta investigación surge con el objetivo de establecer cómo la ausencia de graduación\ny discrecionalidad en la aplicación de sanciones administrativas determina una infracción\nadministrativa en el marco de la Ley N° 28008 – Ley de los Delitos Aduaneros. En\nconsecuencia, se estudiarán los criterios y las presunciones de graduación y discrecionalidad\nen la aplicación de sanciones por infracciones administrativas aplicables de acuerdo con la\nLey N° 28008 - Ley de los Delitos Aduaneros y la Ley General de Aduanas.\nAsimismo, se pretende plantear los criterios de graduación en el ejercicio de\nfacultades discrecionales por medio de presunciones razonables y verificables en los actos\nde los administrados. Nos enfocaremos en los casos más destacados referentes a la aplicación\nde sanciones ante infracciones previstas en la Ley General de Aduanas y la Ley de los Delitos\nAduaneros.\nConsiderando lo manifestado, cabe resaltar que la graduación y discrecionalidad en\nla aplicación de sanciones administrativas está sujeta a la Ley General de Aduanas (LGA),\nque mantiene regímenes de graduación y reglas para aplicar las sanciones reguladas ante una\ninfracción administrativa de dicha ley, mientras que las infracciones relacionadas con la Ley\nde Delitos los Aduaneros no se someten a normas o disposiciones similares para aplicar una\ngraduación o discrecionalidad.
