Muslimske kvinner som tar initiativ til en sivilrettslig skilsmisse i Norge anses ikke alltid av omgivelsene å være skilt i henhold til islamsk lov. De kan ende opp i en situasjon beskrevet som «haltende ekteskap», og mange opplever dette som svært problematisk. For å bøte på situasjonen, og sikre kvinner samme reelle rett til skilsmisse, tok noen stortingspolitikere initiativ til lovendringer. Politikerne var også opptatt av å forebygge bigami og trygdemisbruk. De politiske prosessene som pågikk rundt denne saken i perioden 2003-2005 er særlig interessante fordi de tydeliggjør hvordan retten til religionsfrihet kan komme på kollisjonskurs med prinsipper om likestilling og med diskrimineringsforbudene. Saken viser også med all tydelighet at det pluralistiske, juridiske landskapet er kompleks, og at det foreligger klare begrensninger for hva Norge kan gjøre i forhold til andre lands internasjonale privatrett. Til slutt viser saken at det er ikke alle holdninger eller praksiser vi misliker som lar seg regulere bort gjennom lovverket. I kjølvannet av disse politiske prosessene fikk vi i media en debatt om shari’a-råd som et mulig alternativ til lovendringer. Denne debatten er interessant blant annet sett i lys av de politiske prosessene som foregikk i Canada i 2004. Debatten om religiøst baserte institusjoner som kunne fatte beslutninger ble meget opphetet først da muslimer kom på banen. At katolikker og jøder lenge har hatt tilsvarende organer har aldri vakt nevneverdig oppmerksomhet. I all hovedsak handlet de norske argumentene mot shari’a-råd om kvinners rettigheter i henhold til islam. Av spesiell interesse må det sies å være at mediedebatten i 2003 i liten grad ble ført på et prinsipielt grunnlag.
