Abstract
Deze thesis onderzoekt hoe en onder welke voorwaarden positieve maatregelen, zoals quota, juridisch toepasbaar zijn op genderdiverse personen in België. Hoewel bestaande regelgeving voornamelijk inzet op de man-vrouwverhouding, groeit de vraag naar inclusieve representatie van non-binaire en transgender personen. Vanuit een normatief en rechtsvergelijkend perspectief worden de Belgische Grondwet, de antidiscriminatiewetgeving en relevante rechtspraak geanalyseerd. Daarbij wordt stilgestaan bij de impact van het Transgenderwet-arrest van 2019 en de wetswijziging van 2022 die ‘genderidentiteit’, ‘genderexpressie’ en ‘geslachtsverandering’ expliciet beschermt. Internationale mensenrechtenstandaarden en voorbeelden uit Argentinië, Canada en Malta tonen dat quota voor genderdiverse personen juridisch mogelijk zijn, mits heldere definities en politieke wil. De thesis besluit dat het Belgische recht wel ruimte laat voor positieve maatregelen, maar dat juridische verankering en verdere hervormingen nodig zijn om de representatie van genderdiverse personen effectief te bevorderen.
