La bicatégorisation sexuée des compétitions sportives invite inévitablement à s’interroger : les athlètes transgenres doivent-il pouvoir concourir dans la catégorie (féminine ou masculine) correspondant à leur identité de genre ? La réponse à cette question, qui dépasse le cadre du sport, est éminemment complexe. Le présent article entend montrer que, en l’état des connaissances scientifiques, le droit ne commande pas plus leur libre inclusion qu’il ne permet leur exclusion totale. Si le principe est bien l’inclusion, il ne s’agit pas pour autant d’un principe absolu. Des limites peuvent ainsi lui être apportées à condition qu’elles constituent un moyen strictement proportionné de préserver l’équité sportive et/ou la sécurité des participants. La légalité ou l’illégalité de limites à l’éligibilité des athlètes transgenres va dès lors varier en fonction : du sens de la transition de genre effectuée (MtF ou FtM) ; des sports pratiqués (tous ne mobilisent pas les mêmes qualités ni ne présentent les mêmes risques) ; du parcours de transition réalisé (social, médical et/ou légal) ; du fait d’avoir subi les effets de la puberté masculine (ce qui n’est pas le cas des athlètes prépubères ou ayant eu éventuellement accès à des bloqueurs de puberté) ; voire du niveau de compétition concerné (compétitions simplement « récréatives » ou véritables compétitions) ; ou bien encore de l’existence d’alternatives à l’interdiction pure et simple (co-classement par exemple).
