Abstract
1:01 The Employer recognizes the Union as the exclusive collective bargaining agent with respect to all matters properly arising under the terms of this Agreement for all of the Employer's Working Foremen, Lead Hands, Carpenters and Carpenter apprentices working in and out of the Facilities & Services and Physical Plant Departments, with the exception of non-working foremen and persons above the rank of non-working foreperson. The term “employee ” or “employees” wherever used in this Agreement shall mean any or all of the employees in the bargaining unit as herein defined unless the context otherwise provides. ARTICLE 2: MANAGEMENT FUNCTIONS 2:01 The Union acknowledges that it is the exclusive function of the Employer to: a) maintain order, discipline and efficiency; b) hire, discharge, direct, classify, transfer, promote, demote, layoff, and suspend or otherwise discipline employees subject to the provisions of this Agreement; c) establish and enforce rules and regulations not inconsistent with the provisions of this Agreement, governing the conduct of the employees; and d) generally to manage and operate the University of Toronto. ARTICLE 3: NO STRIKES OR LOCKOUTS 3:01 The Union agrees that there will be no strike, sit-down, slow-down, picketing or other interference which will stop, curtail or interfere with work, and in the event of any such action taking place, it will instruct the employees involved to return to work and perform their usual duties as well as to resort to the grievance procedure established herein. The Employer agrees that there will be no lockout of the employees during the term of this Agreement.
