En 2014, le législateur canadien mis en place un modèle de criminalisation asymétrique pour traiter de la prostitution. Ce régime juridique se concrétise dans la Loi sur la protection des collectivités et des personnes victimes d’exploitation, adoptée en réponse à l’arrêt de la Cour suprême Canada (Procureur général) c. Bedford rendu en 2013. Ce nouveau régime (« régime post-Bedford) représente une véritable rupture avec l’approche juridique antérieure, qui considérait essentiellement la prostitution comme un enjeu de nuisance et d’ordre public. Dans le nouveau régime, la prostitution est plutôt vue comme étant une activité intrinsèquement violente et comme une forme d’exploitation qu’il est nécessaire de combattre en s’attaquant aux piliers du système prostitutionnel, soit les clients et les tiers exploitants. Ce mémoire propose une analyse critique de l’effectivité du cadre juridique canadien actuel en matière de prostitution. L’effectivité y est entendue comme une application et une interprétation de la loi conforme à la vision et aux objectifs fixés par le législateur. Dans cette perspective, l’analyse se concentre spécifiquement sur la manière dont la Loi C-36 a été interprétée par les tribunaux canadiens afin de déterminer si leur jurisprudence respecte réellement l’approche asymétrique adoptée en 2014, soit une approche visant à dissuader la demande de services sexuels, à réprimer l’exploitation économique liée à la prostitution et à affaiblir le système prostitutionnel dans son ensemble. L’étude révèle que certaines décisions judiciaires ont dévié de ces objectifs en réinterprétant les fondements de la loi de façon erronée.
