En 2015, La Loi visant l’amélioration de la situation juridique de l’animal a été adoptée. Cette loi transforme le statut juridique de l’animal. Autrefois considéré comme un bien, le Code civil du Québec indique maintenant à son article 898.1 que l’animal n’est pas un bien, mais un être doué de sensibilité ayant des impératifs biologiques. Or, une confusion demeure concernant la qualification de l’animal: si l’animal n’est plus un bien, est-il devenu une personne ? Cette question est légitime puisqu’en droit québécois, la summa divisio crée deux catégories : les biens et les personnes. Ainsi, si l’animal n’est plus un bien, qu’est-il devenu ? Le législateur québécois souhaitait-il créer une troisième catégorie entre les biens et les personnes ou a-t-il accordé le statut de personne aux animaux ? Le débat entourant la qualification juridique de l’animal était déjà au cœur de la doctrine et des jugements en droit animalier et ce n’est pas la Loi visant l’amélioration de la situation juridique de l’animal qui vient le régler, bien au contraire. Ce mémoire poursuit la conversation en s’intéressant aux frontières de la summa diviso et à son application dans le contexte du droit animalier. À la suite d’une analyse littéraire de la loi, de la doctrine et des jugements québécois, nous déterminerons l’effet de l’art. 898.1 du Code civil du Québec sur la classification de l’animal au sein du droit civil québécois.
