Abstract
Kanadyjski dualizm, trzy dekady bez ratyfikacji konstytucji I Patriacja 1 kanadyjskiej konstytucji miała być, w zamierzeniach Pierre'a Elliotta Trudeau, końcowym akcentem w podjętym przez niego szerokim programie nazwanym National Policy.Jednym z jego elementów było powołanie różnych instytucji politycznych, administracyjnych i kulturalnych, które miały wzmocnić " kanadyjskość" wielu obszarów życia publicznego, a które według Trudeau zbyt mocno kojarzone były z pozakanadyjskimi wpływami, w szczególności brytyjskimi lub amerykańskimi 2 .Trudeau, spadkobierca i wierny uczeń Henriego Bourassy, ważnej osobistości kanadyjskiego życia politycznego i publicznego I połowy XX wieku, tak jak jego mentor był zagorzałym federalistą i zwolennikiem tzw.podwójnej autonomii: konsekwentnego osłabiania związków z Londynem, a w kwestii quebeckiej przyznania prowincji szerokiej autonomii, ale tylko i wyłącznie w ramach Federacji Kanadyjskiej.Trudeau był także zdecydowanym zwolennikiem zabezpieczania praw jednostek kosztem praw wspólnotowych, co oznaczało nadrzędność praw 1 Patriacja to określenie stosowane w szczególności w stosunku do procesu odzyskania przez Kanadę suwerennego prawa do konstytucji.W polskiej literaturze przedmiotu jest stosowane przez wielu autorów, np.: M.
