El proceso de descosificación de los demás animales -los no humanos- alcanza hoy la esfera constitucional, tensionando a su paso concepciones tradicionales del Derecho. El objetivo de este trabajo es analizar el proceso de descosificación de los demás animales en Chile, a partir de la fallida propuesta de la Convención Constitucional en la materia. Se argumenta que esta experiencia constituyente incorporaba varios elementos vanguardistas en relación a la protección animal, proponiendo un estatus jurídico de “sujetos de especial protección”, que permitía la atribución de derechos subjetivos derivados de su sintiencia, aunque con límites que no cuestionaban del todo su uso y explotación. Se revisan también protecciones orientadas en favor de grupos específicos de animales y también se destaca la consagración de deberes estatales de protección animal, especialmente en relación a la promoción de una educación basada en la empatía y el respeto hacia estos individuos que, como se afirma, constituye un elemento clave para acabar con el especismo.
