Abstract

O presente artigo analisa a responsabilidade civil do transportador aéreo, cotejandoaspectos do Código Brasileiro de Aeronáutica e alguns parâmetros fixados por convençõesinternacionais, como Varsóvia e Montreal, recepcionados pelo Direito brasileiro, emcomparação com as bases jurídicas erguidas após a Constituição de 1988, que inclui a disciplinado seu artigo 37, parágrafo 6º, referente à responsabilização civil do Estado e das pessoasjurídicas de direito privado prestadoras de serviço público, bem como outras leis de grandeamplitude, como o Código Civil, de 2002, e o Código de Defesa do Consumidor, de 1990,promotoras da reformulação de entendimentos doutrinários e jurisprudenciais concernentes àtemática. A metodologia da pesquisa é qualitativa, descritiva e analítica, a partir de fontesbibliográficas e documentais, tendo por escopo central demonstrar algumas evoluções, a partirde análise que cobre cerca de quatro décadas de abordagens sobre esse importante tema doDireito Aeronáutico brasileiro.
